Govt reports action against encroachment: PIL dismissed

BANGALORE: The High Court on Monday dismissed a PIL which had sought a direction for action against encroachment of Government land as infructous after the Government reported that action was being taken to evict the encroachers.

The petition filed by Rajarajeshwarinagar Prajashakti Sangha had alleged that about 13 acres of Government land and sarakari halla at survey no. 52 of

Halagevaderahalli near Mysore Road had been encroached upon by Ideal Homes House Building Cooperative Society in forming its layout, Ideal Homes Township. The Court had directed the Special Deputy Commissioner to inspect the spot and take action in case of encroachments.

Government counsel M N Sheshadri submitted on Monday that action was being taken by the Special DC after finding encroachment of Government land and that Bangalore Development Authority had cancelled the sanction accorded to the layout.

The Division Bench comprising Chief Justice Cyriac Joseph and Justice B Padmaraj dismissed the petition. The Bench directed that the petitions filed by various residents of Ideal Home Township challenging the eviction orders issued by the Special DC, to be posted before appropriate Courts for consideration.

TEMPLE PIL HEARD: The Division Bench heard a PIL by Tapasvi Munianjaneya Swami Seva Samiti which has sought quashing of an order by a Land Tribunal confirming the occupancy rights of about 82 acres of land at Gavipalya village in favour of certain individuals.

The petitioner has challenged the order holding the occupancy rights in favour of one H Mare Gowda alleging it to be against the interest of the Tapasvi Munianjaneya Swami temple situated in Lakshmipura village, Bangalore North taluk.
