HC stays BCC notice on Koramangala building issue

BANGALORE: The High Court, on Tuesday, stayed a Bangalore City Corporation notice threatening demolition of a building if its deviations from the law were not corrected within a week.

The Corporation had given a seven-day ultimatum to a building owner in Koramangala to correct deviations from building bylaws and threatened to initiate demolition procedures if he failed to comply.

A vacation bench comprising Justice V Gopala Gowda granted an Interim Order of stay on a petition by Pratibha Lokesh, owner of a residential building in Koramangala fifth block.

She had said the BCC had not given her adequate time before passing the Order.

The BCC action follows a Division Bench direction to bring compliance of zonic and building regulations in Koramangala to check excessive commercialisation of the area.

The petitioner’s residential building is allegedly being used as the office of Multitech Software Ltd.

The Court observed that similar stay orders had been granted against BCC orders for the buildings of Syeda S Nasir and Syed Humain in Koramangala earlier.

The Court, adjourned the case to October 17 on the request of BCC to explain its action, granted the interim stay on the petitioner’s plea that her seven day period was ending on Tuesday.
