HC stays construction on footpath

The petitioner AV Amarnathan stated that the Bruhat Bangalore Mahanagara Palike (BBMP) was constructing 40 shops on the footpath adjacent to Shivajinagar police station, against the provisions of Karnataka Municipal Corporation Act.

The High Court, on Wednesday, stayed the construction of shops on the footpath, adjacent to Shivajinagar police station compound, on Cockburn Road, following a PIL filed by a city advocate.

The petitioner AV Amarnathan stated that the Bruhat Bangalore Mahanagara Palike (BBMP) was constructing 40 shops on the footpath adjacent to Shivajinagar police station, against the provisions of Karnataka Municipal Corporation Act.

Such construction would hinder the movement on footpath and force the pedestrians to walk on the road. The petitioner sought the court to direct the immediate stay of the construction.

The Division Bench comprising Chief Justice Cyriac Joseph and Justice S Abdul Nazeer, granted an interim stay against further construction, while admitting the petition for hearing.
