The High Court on Tuesday set aside a civil court order restraining BDA from interfering with the land acquired by it in 1978 and made it a part of BDA's Mathadahalli Layout in Gangenahalli.


BDA had acquired the land in Gangenahalli to form Mathadahalli Layout in 1978 and took possession of some lands in 1988. However, it did not take possession of a portion of land from Lakshmamma, a land owner.

The latter sold these lands to Housing Industries Limited, which sold sites formed on the land. However, BDA demolished the structures put up by subsequent purchasers in Feb 2003.

Following suits by the firm and its purchasers, a city civil court had on July 17, 2003 restrained BDA from interfering with their lands.

A division Bench comprising Justice Chidananda Ullal and Justice H N Nagamohan Das termed the sale deeds executed by Lakshmamma subsequent to acquisition of lands by BDA as illegal. Five MLAs - Jagadish Shettar, Allam Veerabhadrappa, B K Hariprasad, S P Muddahanume Gowda and G K Venkatashiva Reddy were among the BDA allottees of sites formed in Mathadahalli Layout.
