Govt files plea to cancel deal with NICE

Bangalore: The state government has filed another petition in the Supreme Court seeking its permission to cancel the agreement with the Nandi Infrastructure Corridor Enterprise. NICE has been contracted to build the Bangalore-Mysore Infrastructure Corridor.
In its petition, the government said: “The world over, governments reserved the rights to cancel projects or re-structure them.
Governments also had the right to get the projects implemented through other agencies if the changed circumstances made the project onerous to the state or there was a need forchange in view of advanced technology or other beneficial developments.”
The petition said it believed it had absolute rights to cancel the project, but was seeking the court’s permission “to exercise its contractual rights in a fair manner.”
Reacting to this, NICE said it will oppose the petition. “The affidavit is a definite contempt of court. The government is trying to distract the court by presenting irrelevant issues before it,” NICE Chairman Ashok Kheny said.
According to him, the affidavit was filed at the insistence of chief secretary P B Mahishi. He has been named in the contempt judgement and therefore is acting with a vengeance”, he alleged.
