Bangalore: Want to legalise your property? Seek an engineer’s help, visit the nearest designated office, pick up a form, fill it up, submit the form along with a DD.
The BBMP will open the counters to sell and receive applications for regularising unauthorised buildings from Friday and will close it on December 14, 2007. People can avoid the usual grind of going through BBMP officials, as the system of giving and receiving applications has been outsourced to post offices, Apex bank and BangaloreOne Centres.
Launching the scheme, BBMP commissioner S Subramanya said people need not seek BBMP’s officials’ help to fill in the applications; information will be given by BBMP kiosks while the applications with hand book can be bought from designated centres and can be submitted there.
“If there are certain issues that are not addressed in the policy, such issues will be discussed with resident welfare associations, architects, engineers on a public platform. We have planned about 100 interactive sessions to discuss issues cropping up on the scheme,’’ Subramanya said.
Where are the booklets available?
The booklet — Sakrama — along with applications can be purchased from 250 post offices, B1 centres and Apex bank branches. For instance, people from Richmond Town can buy it from Richmond Town centres. Applications are priced at Rs 100. Once you fill the form, it should be submitted at the counter from where you purchased it.
What does the booklet contain?
General information about the scheme, FAQs, penalty rates, examples on calculating penalty, category of violations. The application form comes in three parts: while the first part deals with plots on both converted and non-converted layouts, part II will deal with change in land use and part III covers building violations.
Where to get information about scheme?
BBMP has set up information kiosks in its zonal offices, citizen service centres, BBMP complexes, BDA complexes, KSRTC and BMTC bus stations where you can pick up a handout or get all details about the scheme. However, it will neither sell nor receive any application.
Who can apply?
Owners of residential buildings with violations up to 50% and commercial buildings with violations up to 25%; owners of revenue sites with or without land conversion.
How do you ascertain deviations in your property?
It is advisable that you sit with an architect or a structural engineer and calculate the violations according to the provision printed in the handbook. Then, you arrive at the fee to be paid for regularisation, purchase a DD and submit the form. If a building has more than two floors, a structural engineer has to certify it.
How to regularise a property on non-converted land?
Such applications will be processed only after the BDA gives its clearance. The BBMP will send such applications to the BDA and then take it up in the screening committees.
What are the documents needed?
All documents related to the property are relevant. Sale deed, encumbrance certificate, khata extract, GPA, tax paid receipts and other such documents. You need to attach only photocopy and not the originals.
How will I know the outcome of my application?
The process of your application will commence only after December 14. The screening committee will recommend the case for regularisation to the competent authority and a certificate will be issued. If the application is not accepted, then the owner will be informed about the reasons for rejection.
If the application is rejected, is there a provision to appeal?
Yes. You can appeal before the appellate authority set up by the state government.
What are the penalties for various violations?
Penalty for buildings constructed on nonagricultural lands (revenue properties): Residential: 2% of market value of property Commercial: 4% of market value Fine is calculated per sqmt of total builtup area in accordance with market value
Penalty for FAR and setback violations
Residential: Up to 25% violation — 10% of the market value; up to 50% violation - 25% of market value PENALTIES Commercial: Up to 12.5% violation; it’s 25% of market value; up to 25% violation - 40% of market value Calculated as per sqmt of total violated area
Violations relating to site formation
Up to 60 sqmts - Rs 200/sqmt for Bangalore urban and rural, Rs 150/sqmt for other corporation areas Up to 120 sqmts - Rs 400/sqmt in Bangalore and Rs 200/sqmt for other corporation areas Above 120 sqmts - Rs 600/sqmt for Bangalore and Rs 250/sqmt for other corporations
Penalty for regularisation of buildings constructed without plan approval
Residential: 2% of market value Commercial: 4% of market value Fine is calculated per sqmt of total built up area in accordance with percentage of market value
Penalty for land use violation
Residential: Rs 100/sqmt Commercial: Rs 375/sqmt
Other info
Scheme will apply to buildings that have come up before Feb. 3, 2007
Does not apply to certain categories of properties — buildings on encroached land (government land), valleys, drains, tank beds, lands that have HT electrical lines, buildings that are in dispute, forest land, buildings coming in the alignment of proposed road or rail network and buildings that have come up on lands which are not designated for particular land use
Does not apply to industries categorised as red by state pollution control board

Nice job done Bangalorean. I am trying to figure out information for what to do for owners of revenue plots. CMCs stopped collecting betterment charges for these. I am not getting clear picture if by opting for this scheme will provide relief to those.

I went to B1 and a post office to get application for regularization but was suprised to find that not only that they don't have the forms, they also have no information on the matter!

the time may be considered for extention. pl clarify to understand by any layman to know what to do with revenue / grampanchayat sites and sites formed by a housing society without BDA approvals.
