The High Court disposed of a writ petition by owners of two apartments of Koramangala area with regard to the bridges over a nearby storm water drain, while directing them to approach BBMP regarding the issue.

The petition by Hibiscus Apartments and Sherya Apartments located on 1st Main Road, Jakkasandra in Koramangala had petitioned the Court, apprehending demolition of two bridges they had constructed over the nearby Storm Water Drain.

They had stated that BBMP had proposed to re-model the bridges but, until that was done, the existing bridges should be retained as they were the only access to the residents to ply across to their apartments.

They also pointed out that BBMP had demolished a coverage put up onto the drain by them, to avoid bad smell of sewage water.

The Court observed that legally, the apartments were entitled to construct only one bridge and they could approach BBMP for permission for separate bridges.

While observing that BBMP had powers to prevent blocking of drains, the court also advised it to take steps to prevent health hazards from flowing sewage. The court said, the residents could approach BBMP regarding the issue of bridges and explore the possibilities of having the bridges without blocking the drain.

Plea dismissed

Justice N Kumar dismissed a writ petition filed by Narayanappa of Uttarahalli, Bangalore South taluk. The petitioner had moved the Court against BDA’s initiative to construct a road in Doddakallasandra.

The petitioner had claimed about 2 acre 3 gunta land in Doddakallasandra as his own and sought an order against interference of BDA.

In the course of arguments, the judge observed that the land belonged to BDA and the petitioner had suppressed the fact.
