Bangalore Mahanagara Palike has conducted special survey on violation of building bylaws in the commercial and apartment complexes that are under construction in the city. It has also conducted a survey on basement use violations across both the old and upcoming structures.

Keeping an eye on violations of the like is a routine exercise expected of the BMP officials. For that matter during the famous Koramangala demolitions of buildings, violating zonal norms and sanctioned building plans, one question that was repeatedly asked by the common man was what was BMP doing when the structures were coming up violating the rules. The special survey comes close on the heels of the State Assembly recently approving the bill on regularisation of building bylaw violations (The Karnataka Town and Country Planning and certain other Laws Amendments Bill 2004) The bill is yet to receive the Governor’s assent.

According to a section of BMP officials, almost 99 per cent of the upcoming structures being surveyed are seen to be violating the existing rules. “We will issue notices for rectification as per the existing rules; their scope for regularisation when the new law is notified will also be considered,” said one official. Does the BMP see builders and land developers taking advantage of the time-gap before the new law is notified? Officials declined to comment.


As far as basement use violations (mostly pertaining to space earmarked for parking being used for commercial or other purposes) are concerned - Malleshwaram, Jayanagar and Shantinagar are learnt to be the prime areas. The BMP had earlier initiated action against some 80 parties for violating basement use norms, most of them are pending before the court, sources said.

Incidentally, the just passed bill is firm that no regularisations shall be permitted in case of violation of basement spaces meant for parking.
