Plea against toll dismissed

The High Court has dismissed a petition seeking stay on collection of toll by Nandi Infrastructure Corridor Enterprises (NICE) on its peripheral roads.
V Nagaraj, the petitioner and state co-ordinator, Dalit Sangharsha Samiti, had moved the High Court stating that the outer peripheral road alignment for which the company is collecting tolls was not the one defined in the agreement. He had prayed for quashing the notification dated Dec 18, 2008 which allowed toll collection.
The petitioner had contended that the orders of the High Court and Supreme Court directing to “implement the project as originally conceived in the letter and spirit of Framework Agreement,” have been violated since the alignment had been changed by two kilometres.
The petitioner had alleged that the clearance from Karnataka State Pollution Control Board and Ministry of Environment and Forests had not been obtained and neither Environment Impact Assessment (EIA) conducted for the altered alignment.
The division bench comprising Chief Justice P D Dinakaran and Justice V G Sabhahit dismissed the petition questioning the petitioner, “ What were you doing for the past ten years ?”
Notice ordered
A division bench of the High Court has ordered notice to the Union Government and Railways Department in connection with a petition seeking shifting of the parking lot at the Cantonment railway station.
In his Public Interest Litigation, S Sadanand, a city resident has sought to shift the parking lot now located opposite railway station, towards the railway terminus. He has contended that the present arrangement was causing inconvenience to passengers as they had to struggle to cross the busy road outside the station. Efforts to convince Railway Department went in vain as it felt that such a measure would pose a security threat to the terminus. The petitioner has sought a direction from the Court allowing temporary parking of motor vehicles, especially for the aged, sick and physically challenged, on the left side of the station, now a prepaid autorickshaw stand.
