BANGALORE: The High Court on Friday vacated its stay on the order of Bruhat Bangalore Mahanagara Palike (BBMP) which cancelled collection of parking fee on 10 roads of Bangalore East division. In view of the interim order of the High Court, parking fee cannot be collected from January 24, 2009.
Justice Ravi Malimath vacated the stay order of January 13, 2009, in which the court had given permission to Subramanya (petitioner) to collect the parking fee in the East division of Bangalore.
The BBMP argued that the additional commissioner of BBMP had no power to pass an order regarding collection of parking fee since the joint commissioner of BBMP had no such power to give permission to collect the parking fee.
In an application filed, the BBMP stated that the question of collecting parking fee would not arise until and unless the decision was taken by the council of BBMP or by the administrator.
Further, the BBMP counsel argued that the permission to collect the parking fee would arise only after floating tenders.
“The BBMP has not issued such tender notification.
Without calling for tenders, the BBMP has no power to give permission to collect the parking fee,” the commissioner added in the application.
“The petitioner (Subramanya) is collecting the parking fee according to his whims and fancies. The BBMP has not authorised him to collect the parking fee and has not fixed the amount of parking fee. If the stay is not vacated, it will cause injustice to the public,” Ashok Harnahalli, BBMP advocate argued.
