The Bangalore Mahanagara Palike (BMP) has stated that it has cancelled the licence given to a private party for constructing a residential apartment in NIMHANS premises.

The Joint Legislature House Committee, headed by Mr A T Ramaswamy, which had recently visited the site had observed large-scale encroachment of government land at the building site. Following a report in Deccan Herald, the BMP’s joint director for town planning has clarified that the BMP had sanctioned a plan to Mr K V Shivakumar for construction of an apartment on property number 49, 8th Main Road, Byrasandra based on the documents produced by him on August 8, 2005.

Meanwhile, NIMHANS claimed that the property had been granted to them by the government in 1944. As both parties had claimed the title of the same property, the BMP Commissioner withdrew the licence (sanctioned plan) issued to Mr Shivakumar on January 24, 2006. Mr Shivakumar filed a writ petition before the Karnataka High Court.

On April 19, 2006, the HC directed the BMP to hear both parties. The BMP Commissioner who scrutinised the documents and heard the arguments on both sides, passed an order on August 2, 2006, cancelling the licence issued to Mr Shivakumar.
