Civic body told to pass orders after looking at replies to notices

BANGALORE: The Karnataka High Court on Thursday directed the Bangalore Mahanagara Palike (BMP) not to demolish a building in Koramangala till the next date of hearing and asked the BMP to pass orders after looking at the replies given to the notices issued by it to the petitioners. A Division Bench comprising the Chief Justice Nauvdip Kumar Sodhi, and Justice N. Kumar was hearing a public interest litigation (PIL) petition by some residents of Koramangala alleging large-scale violations of building norms and illegal change in land use in the locality.

When the matter came up for hearing, the petitioner Syeda Nasir, said the BMP had issued a notice to her, saying that the building she built had violated the norms. She wanted more time to file her reply. The Bench agreed to the petitioner's request for more time and adjourned the matter to October 28.

Meanwhile, three tenants of a building in Koramangala also appealed against the BMP notice. When the Bench sought to know why the building owner had not challenged the notice, the tenants said some of the building owners were using the court order as a tool to get the tenants evicted. When the BMP sought a week's time to file written statement, the Bench adjourned the matter to October 28.
