BDA’s lackadaisical attitude stinks

Bangalore: Pulling up the Bangalore Development Authority (BDA) for its lackadaisical conduct in not protecting its property, the Karnataka High Court observed that the "whole thing stinks and it is the hoax of the century."

Justice Ram Mohan Reddy made these observations while disposing of a petition which sought a direction to the authorities to issue a khata for a site at Vijaynagar.

M P Sunitha Kumari of RPC Layout, Vijaynagar submitted she was allotted a site by BDA along with 41 others at Vijaynagar (B&ASO Block) in 1991. However, the BDA directed the Bangalore City Corporation(BCC) not to issue the khata since there was a fraud in the allotment. A CoD probe was ordered and after a B-report (closure of case) was filed, the BDA said the matter was clear and the khata could now be issued.
When the petitioner approached the BCC, she was told to obtain a no objection certificate from the BDA. She challenged the same before the court.

During the course of arguments, it was pointed out that after the CoD had given a clean chit the matter was referred to the CBI, which in its report stated that there was a prima facie case of fraud in the allotment of sites. Subsequently, the High Court was moved, which in its order, reserved the right to the BDA to protect the property allotted in an alleged fraudulent manner.

Justice Reddy, while coming down heavily on the BDA for not taking any action, observed, "Strange is the conduct of the BDA that even after a lapse of so many years a claim has not been staked on the property." The court, while commenting on the role of the BCC in seeking an NoC, said the same is without justification.
A direction was issued to the BCC to issue the khata in the name of the petitioner.
