HC upholds land acquisition for BMIC project

BANGALORE: The High Court on Thursday upheld the land acquisition for peripheral road project of NICE by dismissing a batch of writ petitions filed by farmers.
While dismissing the petition, Justice BS Patil upheld the acquisition by Karnataka Industrial Area Development Board (KIADB) The court said, “It is unfortunate that despite such long-drawn litigations reaching finality before the Apex Court. The same court had rejected the petitions challenging the acquisition.
The petitioners again approached this court for the same relief,” the court said.
“The Apex court had confirmed the judgment of the division bench of High Court directing that the project be implemented. If these petition is permitted, a party can file as many as writ petitions as he likes. The contentions by the petitioners cannot be accepted,” the court said.
The petitioners had sought directions to NICE and the state government to adhere to the framework agreement of November 20, 1995. If it is followed no lands of the petitioners are required for the BMIC project, the petitioners said.
The petitioners alleged that NICE had committed fraud in the Apex Court and High Court by suppressing facts.
It had illegally acquired land for the peripheral road project, they said.
KIADB had acquired 20 acres of land in Chikkathoguru, Pantarapalya, Gollarahalli, Hosahalli, Gottigere and Konappana Agrahara between 1999 to 2003. The proceedings of land acquisition was challenged by K Karehanumaiah and others. The High Court dismissed few a batch of writ petitions.
However, a few writ petitions challenging the land acquisition are still pending.
