BANGALORE: A couple running a diagnostic centre in their residential building in Koramangala approached the High Court on Monday against a Bangalore Mahanagara Palike Order asking them to remove the centre from their residential premises.

Dr C S Vijaykumar and Dr Prabhavati stated that the BMP had issued a notice on October 28, 2005, directing them to remove their consultation room and diagnostic centre in 3rd Block, and to restrict the building for residential use.

They complained that the Order had held their centre as running in violation of Zoning Regulations whereas such use of residential buildings for providing vital medical care was permissible.

The doctors challenged the validity of the Order and sought an interim stay. But Justice Ram Mohan Reddy directed it to be posted before the Division Bench comprising the Acting Chief Justice on Tuesday.

He observed that the petition was connected to the anti-violation action in Koramangala being monitored by the Division Bench comprising the Chief Justice, which had directed the Court Registry, to list all such matters before it alone.

Justice Ram Mohan Reddy also sought the Court Officer to enquire how the Registry had posted it before him in spite of such a direction by the Bench.
