Bangalore: The number of notices issued to properties which have violations in Koramangala has gone up to 120. It will go up further.
The area, which has around 5,000 properties, according to a BCC survey, has many more violations. The reasons for which notices have been issued include zoning violations, land use, change in building plan.
Later in the month, the BCC is expected to submit a report to the High Court about how many violations exist in Koramangala. The action taken report is slated to follow this report.
To subvert counter-action, the BCC has also geared itself for a legal battle by filing caveats regarding these properties that have been identified as having some violation.
The BCC’s counsel in the high court has filed over 130 caveats regarding these properties.
After the BCC issued the show-cause notices giving the owners a week’s time to correct the violations, three persons — Pratiba Lokesh, Syeda Sarah and Syed Humayun, approached the high court and obtained a temporary stay against the BCC’s demolition order. The high court stay will be operational until October 17.
The issue of the stay will be taken up before the division bench of the high court when they meet after the vacation.
It may be recalled that a PIL had been filed by residents of Koramangala consisting of Dr Vijayan Menon, Dr Devi Shetty and other residents in April seeking high court direction against rampant building violations, land use and zoning violations in Koramangala and the High Court had urged the BCC to take action against 87 properties which had been identified as having some kind of violation. The BCC notices had been made in response to the high court direction. Meanwhile, as the survey threatens to expose more violations. More notices and demolition orders are expected.

Whats the process that's followed? BCC issues demolition notices, folks get a stay order, before the stay is vacated folks modify building as per original approved plan, after stay is vacated, if buildings are in violation, BCC undertakes arbit destruction which might leave the other part of thebuilding which probably is as per the plan semi-demolished too?
