BDA gets embroiled in litigation

Bangalore: The high court on Wednesday issued a notice to the BDA and others following a petition filed by Nandi Infrastructure Corridor Enterprise (NICE) and Nandi Economic Corridor Enterprise (NECE), and another challenging the BDA’s move to acquire around 22 acres of land for its Hi-Tech City near Hosur Road. As the land in question overlapped with the projects of NICE and BDA, the former asked the court to direct BDA to modify its plan.

In their petition, NICE and NECE said the land of around 22 acres in question had already been notified by the government for the southern Outer Peripheral Ring Road between Sarjapur Road and Hosur Road.

The BDA prepared a development plan for its Hi-Tech City project, which included around 8 acres in Dodda Thogur village and 11 acres in Konappana Agrahara. NICE, however, submitted that in 2003, the state had notified the land for the Peripheral Outer Ring Road.

The petitioners contended that despite several meetings with the respondents, the state had not taken any steps on the overlapping of survey numbers for the two projects.

Flyover project: The high court on Wednesday ordered status quo on petitions filed by UP State Bridge Construction Corporation which challenged a termination of the BDA’s contract letter and also calling for tenders to complete work of the flyover near Jayadeva Institute of Cardiology.

The petitioner said it obtained a contract from BDA for construction of flyover/grade separator at the Airport Road-Intermediate Ring Road junction, Bangalore Dairy Circle and near Jayadeva Institute of Cardiology. On account of delay in sanctions by BDA and the state, work had not been completed, and the petitioner had sought extension from the BDA on June 2, 2004 till June 30, 2005.

However, on December 13, 2004, the BDA sent a letter of termination to the petitioner on grounds that the works had not been completed.
