BANGALORE: An apartment in Jayanagar I Block has come up, throwing the provisions of CDP to winds, with even the Bangalore City Corporation admitting that the apartment is being built on land meant for a road.

The apartment ‘‘Raj Prakruti’’, has been allowed to be built by BCC (vide LP No DC/S/93/02-03 dated 18.09.2002) though the land has been designated as ‘‘partly road and partly residential’’ in the revised CDP of by the BDA.

Though the change of land use can be granted by BDA under Section 14 of the Karnataka Town and Country Planning Act, the land designated for public use cannot be converted to private use without obtaining public approval after inviting objections. The residents however maintain that no objections were invited before BCC granted the building permit.

Further, the apartment is on the dead end of the 4th Cross Road and was earmarked for extending it to provide access to NIMHANS area and Siddapura Layout.

The lack of direct access from Jayangar I Block to NIMHANS and Siddapura Layout has resulted in detours and the problem can be solved if the 4th Cross is extended in keeping with the provisions of CDP, the residents feel.

Strangely BCC sent a letter to the Jayanagar I Block residents’ association ‘FORCE’ admitting that the land was reserved for road extension but did not commit on the future course of action. In a letter to FORCE, assistant director (Planning - South) said the BCC has not issued the building permit as the land is reserved for the road.

This is serious. People who have put down money should verify facts with Bangalore Mahanagar Palike.
