High Court Issues Stay Order Till First Week Of June

Bangalore: The KSCA, which received a jolt in the form of twin blasts last week, finally has something to cheer. The high court on Friday extended the stay with regard to Bangalore Metro work near the stadium, till the first week of June. The court also adjourned the hearing on the interlocutory application filed by BMRC, seeking vacating of the February 6 stay order. The KSCA has challenged the December 3, 2009 final notification for acquisition of 3,322 sqm of land beside the stadium, claiming that BMRC had indicated the stadium would be intact. The court, thereafter, stayed proceedings and extended the interim order in view of the IPL.
NO SANCTION FOR STATION
The proposed Metro underground station at Vidhana Soudha was not cleared by the state cabinet, advocategeneral Ashok Haranahalli informed the court on Friday. Meanwhile, a division Bench headed by Justice Manjula Chellur posted the matter after the summer vacation. In its application seeking approval, the horticulture department stated that BMRCL requires 11,160.86 sqm area temporarily and 2,126.71 sqm area permanently, to house the underground station and ancillary buildings.
KSCBC CASE: STATUS QUO ORDERED
A division Bench has ordered status quo for four weeks with respect of the chairman and other members of the Karnataka State Commission for Backward Castes. C S Dwarakanath and others alleged that the 2009 amendment rules, which came into force from April 3, 2010, have virtually curtailed the power of the chairman by equating him with a minister, though as per the Act, it was almost equivalent to that of a high court judge.
NOTICES ISSUED
A division Bench ordered notices to the state government, BBMP and BMRCL, with regards to a PIL challenging the proposal of Mantri Developers to open six multiplexes on the 8th floor of their complex near Malleswaram Circle. The petitioner has alleged that the rules governing high-rise buildings have been given the go-by, with very little setback on either side of the building. The proposed multiplexes would aggravate traffic jams. They have not obtained clearance from KSPCB. The space left for car parking is meagre and they also propose to have a Metro rail station inside the commercial complex under PPP model, which is again harmful from the traffic angle, petitioner Deveshon claimed.
Notice to state and Centre over IPL
A division Bench on Friday ordered notices to the central and state governments with regard to a PIL, which sought probes by the CBI and income-tax department into the affairs of IPL and the Karnataka State Cricket Association. “Anyway, we cannot do anything now about the shifting of semifinals, which are over and our team (RCB) had already lost,” the Bench observed in a lighter vein. The government advocate told court there are inquiries going on throughout the country into various allegations.
