HC quashes BDA's order

HC quashes BDA's order
Bangalore, DH News Service:
The High Court on Friday quashed the Bangalore Development Authority’s (BDA) orders dated March 31, 2009 to several shops and commercial establishments at Indiranagar, Austin Town and RT Nagar BDA complex.

Justice Mohan Shantanagoudar, on hearing a petition by Ramesh Rai, who had challenged the common order to vacate the premises, quashed the order and observed: “The BDA has not applied its mind and has issued cyclostyled orders indicating termination of license of the premises in question on the ground that the entire complex is in a dilapidated condition.”

Sampat Anand Shetty, counsel for the petitioner, submitted that like the petitioners, even the government offices- KAT, CAT, RTO and the Karnataka Fisheries Development Corporation Ltd- had also been served with the notice to vacate by BDA, citing renovation.

Justice Mohan Shantanagoudar quashed the order, but granted Bangalore Development Authority the liberty to evict the occupants of the complex in any other manner known to law.
