Bangalore: Be prepared to pay and park — at least for the next two weeks — on MG Road and other major roads. The Karnataka High Court on Tuesday stayed for two weeks the Jan 2 BBMP order cancelling the pay-and-park contract issued in favour of one G Subramanya.
The roads for which Subramanya was awarded contract are M G Road (from KidsKemp to Richmond Road), St Mark’s Road, Lavelle Road and cross roads, Krishna Temple Road, Indiranagar, Brunton Road, Ali Askar Road, Miller’s Road, Koramangala V Block and Miller’s Road (Bangalore East).
The petitioner has claimed that the assistant revenue officer awarded the contract on Dec 29 and the BBMP additional commissioner cancelled it arbitrarily on Jan 2. Govt told not to collect entry tax
Bangalore: The high court on Tuesday directed the government not to collect special entry tax from assesses until further orders. A division Bench headed by Chief Justice P D Dinakaran stayed the March 29, 2007 order of the single Bench with respect to refund of amount already collected as special entry tax, and allowed the authorities to quantify and calculate the amount.
The government filed an appeal challenging the single Bench order, which struck down Section 3 of the Karnataka Special Tax on Entry of Certain Goods Act (2004), popularly known as special entry tax, as unconstitutional.
“India is a single unit and there should be no internal trade barriers. Such artificial barriers would impede on the constitutional right of freedom of trade and commerce,” the single Bench had said, while asking the government to refund amount collected under provisions of the Act to the traders.
The government, in October 2004 had imposed special entry tax on resale of 23 commodities.
BBMP will try to get stay vacated
The HC on Tuesday stayed the BBMP order cancelling the pay and park contract. When contacted, BBMP additional commissioner (east) Puttaswamy said he could not be present at the hearing as he received the notice late on Monday evening. The palike will request its advocate to move the court and get the stay vacated, he told TOI.
