Govt and BBMP served notices

The High Court on Monday ordered issue of notice to the State government and BBMP in connection with the sale of the Binny Mills playground.


The petitioner, C V Gidappa, a City-based advocate and party in person, sought directions from the Court to retain the 16.6 acres of land as a playground and school.

He stated that the land was allotted by the then Maharaja of Mysore to set up a model village during 1934 on certain conditions.

The petitioner further submitted that following a permission to dispose some properties to revive the sick industry, under rehabilitation plan, the respondent ETA, Karnataka Estates Limited (erstwhile Binny Karnataka Limited) sold a portion of the playground to V Somanna trust at a cost of 21.78 lakhs, while the stamp duty paid was Rs 11.71 lakhs.

Take back the land

He said that the land was inturn sold at a cost of Rs 2.74 crores to United Mega Builders by the Sommanna trust and sought directions to retain the land as playground. Also, he sought directions to the State government to take possession of the land granted by the then government, again. He also suggested to the BBMP to develop it as a playground.

The Petitioner alleged that the ETA had claimed the property as its own, while it is marked as playground in the blueprints.

The Division bench comprising acting Chief Justice Deepak Varma and A S Bopanna who heard the matter has ordered notice to the State government and MD, ETA.
