The Transport Department has raised this question when the Bangalore city police are making preparations to implement the provisions of the Motor Vehicle Act which prohibits use of tinted glasses.

According to the Transport Department sources, the provision of the Motor Vehicle Act pertains to technical specifications of motor vehicles and the police have no role to play in the implementation of this provision of the law.

The police also have no power to book cases against the owner or the driver of vehicle fitted with tinted glasses. The police could take action in cases of violations pertaining to driving licence and other offences specifically provided in the Act and the Rules. The police would get power to initiate action in this regard only when the government issues a gazette notification under the Section 100(2) of the Motor Vehicles Act authorising the police as law enforcing agency. The Government has not issued such notification, sources said. However, the Traffic Police are in favour of implementing curbs on tinted glass from January 15.

Speaking to Deccan Herald, Bangalore Police Commissioner Ajai Kumar Singh said the traffic police would not be conducting any drive but would be implementing the law. “We would request the public to follow the law,” he said. “Some people have raised concerns about personal safety and safety of belongings in the car. We are looking at these implications too. We would be asking the drivers to change them according to the norm.”
